Restaurant to Stay Open Despite Bench Warrant, Positive COVID-19 Case

HOLLAND (WOOD-AM) - Marlena's Bistro and Pizzeria on Lincoln Avenue in Holland is staying open despite a judge issuing a bench warrant over its refusal to close during a state-required shutdown.

It comes after a patron tested positive for coronavirus. The Allegan County Health Department says that person was there between 11 a.m. and 1 p.m. on February 27.

Mask-wearing and social distancing practices were ignored, the health department said.

"The judge has no authority to violate the rights of the people and the constitution of the United States," owner Marlena Pavlos-Hackney told WOOD-TV.

The Allegan County Sheriff's Office says, though it's aware of the case, they're not involved.
