Federal judge: Former MSP sergeant won't face trial for Sterling death

A federal judge is ruling former Michigan State Police sergeant Brian Keely will not face charges in connection to the death of Samuel Sterling.

Brian Keely was charged with second-degree murder and involuntary manslaughter in the 2024 death of Sterling.

Sterling was wanted on a number of warrants and ran from police at a Kentwood gas station on April 17, 2024. Police chased Sterling on foot while Keely pursued in an unmarked police cruiser.

Keely hit Sterling with his SUV outside a Burger King. Sterling was hospitalized and died hours later.

The judge ruled Keely was protected under the Supremacy Clause.

A federal judge ruled last August that Keely was acting as part of a U.S. Marshals task force when the incident happened which means the case fell under federal jurisdiction and moved the case out of state courts.
