PONTIAC, Mich. - On Friday, a judge will decide whether or not to allow prosecutors to file charges on abortion cases, until the state courts rule on challenges to Michigan’s 1931 ban.
In court earlier this week, Gov. Gretchen Whitmer's attorneys said the 1931 law carries felony penalties for “procuring a miscarriage".
Lawyers representing the county prosecutors argued that the injunction is moot. They said the state’s constitution does not currently include any protections covering abortion.
