Michigan Judge halts MI SOS Election Day gun ban near polling places

DETROIT (WOOD TV) — A Michigan Court of Claims judge on Tuesday used a preliminary injunction to place a sudden ban on the open display of guns near Michigan polling places on Election Day.

The Judge, Christopher Murray, acted within a few hours after hearing a challenge from gun-rights groups.

In their suit, a gun rights group argued that Michigan Secretary of State Jocelyn Benson, a Democrat, had exceeded her authority this month in banning people from openly carrying guns within 100 feet of polling places.

Those opposed to the law, argued that Secretary of State Benson failed to go through a formal rule-making process as required under state law. Murray agreed.
