LANSING, Mich. (WOOD) — She's already had several lawsuits filed against her stemming from some of the actions and executive orders surrounding the COVID-19 outbreak in Michigan and now Gov. Gretchen Whitmer is being sued by a Congressman from Michigan.
The newest legal action is a federal lawsuit filed by U.S. Rep. Paul Mitchell on Monday. He represents Michigan’s 10th Congressional District in the Thumb region.
Republican Paul Mitchell says he is suing the governor as a private citizen, not as a congressman. Mitchell believes the governor’s stay-at-home order violates Article 4 Section 4 and the 14th Amendment of the U.S. Constitution.
The congressman says the 14th Amendment reads, in part, “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law.”
The governor is acting without the input of other elected officials like the legislature, acccordng to Mitchell.
